1. Preamble

1.1 Application of our terms and conditions
These general terms and conditions of sale apply exclusively to all persons making a purchase through the RemovablePoolFence.net website, published and operated by the company NETBUY SAS, 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France), RCS CANNES 822 581 633, TVA FR18822581633. These general terms and conditions of sale are expressly accepted without reservation by the customer, who acknowledges having full knowledge of them when placing any order on the site.

As these general terms and conditions of sale may be modified at any time and without prior notice, the applicable terms and conditions are those in force on the site at the date of the order. Any other general conditions of sale produced by the customer will have no legal value and will not engage the responsibility of RemovablePoolFence.net. The customer declares that he/she is at least 18 years old, has legal capacity or is in possession of parental authorisation allowing him/her to place orders freely on the site. He/she further declares that he/she is aware that these general terms and conditions of sale do not require a handwritten signature in order to be accepted and engage his/her responsibility once he/she has validated his/her order for equipment online.
1.2 Responsibilities
RemovablePoolFence.net is fully liable to the Customer for the proper performance of the obligations resulting from the contract, whether these obligations are to be performed by itself or by other service providers, without prejudice to its right of recourse against them.

However, RemovablePoolFence.net may be exonerated from all or part of its liability by proving that the non-performance or poor performance of the contract is attributable either to the customer, or to the unforeseeable and insurmountable act of a third party unrelated to the supply of the services provided for in the contract, or to a technical problem or incident on the site at the time of validation of the order, or to a case of force majeure or events such as lock-out, strike, total or partial work stoppage in the seller's factory or at its suppliers, epidemic, war, requisition, fire, flood, interruption or delay in transport, legal or administrative measures preventing, restricting, delaying or prohibiting the manufacture or import of the goods, the seller is released from all liability upon delivery. RemovablePoolFence.net will keep the buyer informed in a timely manner of the cases and events listed above. In all cases, delivery on time can only take place if the buyer is up to date with his obligations towards RemovablePoolFence.net whatever the cause. 2. Ordering

2.1 General
The selling prices of the products offered on RemovablePoolFence.net, indicated in Euros, are those in force at the time of registration of the order form by the Buyer within the limit of available stocks and subject to typographical error or modification of the French VAT rate. The prices, texts, images or promotions displayed on third party websites (comparators, partners...) will have no legitimacy when the Buyer orders products from RemovablePoolFence.net.

Prices do not take into account the cost of delivery of goods to the customer, which will be indicated and invoiced additionally when the order is recalled and validated, unless otherwise stated on the product sheet. Prices include the value added tax (VAT) applicable on the date of the order and any change in the applicable VAT rate will be automatically reflected in the price of products sold on the RemovablePoolFence.net site. The prices shown on your order after it has been validated and recorded are firm and final: if prices fall a few days after the order has been placed, we cannot under any circumstances compensate you for the difference; if prices rise, we are committed to delivering to you at the price fixed on the day the order was placed. Our goods are payable to NETBUY SAS. The due dates shown on our invoices apply.

We reserve the right to suspend or cancel orders in progress without prejudice to any other remedy. All orders are payable in full and in a single instalment at the time of ordering, except for special offers indicated on the site and subject to a specific payment such as payment in several instalments by bank card or financing (non-exhaustive list, see conditions indicated on the product sheets). RemovablePoolFence.net reserves the right to modify its prices at any time and without prior notice. Products are always invoiced on the basis of the rates in force at the time the order is registered. No discount for early payment will be granted. Deposits paid by the customer are to be applied to the price of the order and do not constitute a deposit, the abandonment of which would authorise the parties to withdraw from the order.

The prices shown are those of RemovablePoolFence.net and cannot be applied in shops operated by NETBUY SAS. Manufacturers may change the technical composition of product references without notice. RemovablePoolFence.net has the right at any time to update or improve its data sheets or to withdraw its products from sale. It is your responsibility, if you do not consider yourself sufficiently competent, to seek advice. You may contact RemovablePoolFence.net to obtain additional information on the products presented via the contact page of our site. Any order from a customer with whom a payment dispute is being processed by the accounting department of RemovablePoolFence.net may be subject to non-delivery or cancellation by RemovablePoolFence.net.
2.2 Special orders
As Beethoven fences are customised products made to order (net colour, post colour, length, etc...), any sums paid cannot be qualified as advances or deposits. Furthermore, they may not be interest-bearing within the meaning of Article L.131-1 of the French Consumer Code.
2.3 Payment in three/four instalments by Casino and Cetelem Bank Card
As part of specific commercial operations, RemovablePoolFence.net may offer payment in three or four instalments by bank card via its partners Banque Casino and Cetelem. In the event of total cancellation or partial reimbursement of the order before the end of the payment period, the outstanding sums will be collected on the dates indicated to the customer when the order was validated. In the case of payment by credit card in three or four instalments, the total or partial reimbursement of the order will be made by cheque at the end of the instalments and after final collection of the sums due or by crediting the credit card again. No unilateral changes to orders will be accepted after your order has been dispatched and the 1st third has been paid.
2.4 Non-payment
In the case of payment in several instalments and whatever the means of payment used (bank card, cheque, etc...), non-payment of a single instalment on its due date will render the entire price immediately payable, whatever the conditions previously agreed. In the case of payment in several instalments by bank card or cheque and in the event of your direct debit being rejected by your bank in accordance with the payment schedule agreed when you placed your order, a €30 rejection fee will be payable for each instalment rejected. This payment is only authorised if you have paid the full instalments of a previous order registered with deferred payment.

RemovablePoolFence.net reserves the right to suspend or cancel any order and/or delivery, whatever their nature and level of execution, in the event of non-payment of any sum due by the Buyer, or in the event of a payment incident. Penalties of an amount equal to the legal interest rate increased by two points are automatically applicable to unpaid amounts at the end of the invoice date or upon notification of the rejection of bank payment for any other means of payment without the need for prior formal notice and without this clause excluding additional damages. Penalties will be payable from the 1st day following the payment date shown on the invoice. Delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions herein.

For orders to be paid by cheque, bank transfer, finance or money order, non-receipt of the sum due will not result in cancellation of the order unless agreed otherwise between the parties. Consequently, the purchaser will remain indebted to RemovablePoolFence.net for the amount of the order except in the case of cancellation by registered letter under the conditions indicated in article 2.8. The electronic signature constituted by the "double-click" procedure when the order is placed and recorded has handwritten value between the parties. Any cancellation by the customer of an order or contract, other than in accordance with the relevant clauses, shall give rise to damages. RemovablePoolFence.net may invoice the purchaser for debt collection costs. In the event of legal action, RemovablePoolFence.net is entitled to claim from the purchaser the reimbursement of costs of any kind related to the proceedings. In case of non-payment, eight days after a formal notice remained without effect, RemovablePoolFence.net reserves until full payment a right of full ownership on the equipment sold, may repossess by summary order issued by the President of the Commercial Court of Grasse. This repossession will not exclude other legal proceedings being taken by RemovablePoolFence.net. The buyer may never, on the grounds of a claim made by him, withhold all or part of the sums due by him, nor operate a compensation.
2.5 Promotional codes and vouchers
Promotional codes and vouchers are only applicable to the total amount including all taxes but excluding delivery costs and cannot be accumulated. Only one promotional code or voucher will be accepted per order. Promotional codes or vouchers cannot be exchanged for their monetary value. The customer will not be able to simultaneously use a promotional code and a voucher for the same order. Vouchers are personal and non-transferable, and can only be used once by the customer when validating their order. The validity date of each voucher and the terms of use are specified on the document given to the customer (voucher sent by email or paper voucher). In order to benefit from the discount linked to promotional codes, it is imperative to quote your code when placing the order by telephone, or to enter it in the box reserved for this purpose when placing the order on RemovablePoolFence.net. If you forget, we will not be able to cancel the order or renew it to take account of this promotion if the order has already been processed. Promotional codes are only valid for the periods indicated on the site. Vouchers are only valid for the conditions indicated on the voucher (validity date and minimum purchase amount).

In the event that the customer does not enter the promotional code when validating their order and consequently does not benefit from the discount granted by this promotional code, RemovablePoolFence.net cannot cancel the customer's order or reimburse the customer for the amount of this discount. Any request from the customer by email or telephone after the order has been placed will not be processed or accepted. Any fraudulent use of a promotional code (codes reserved for certain special operations, discounts, limited offers, etc.) or a voucher will render the latter null and void. RemovablePoolFence.net reserves the right to cancel, modify or suspend any order for which payment has not been received (bank cheque, finance, money order, bank transfer, etc.). In the event that the order has been validated and paid for by the Customer, the code or voucher will be removed from the order and RemovablePoolFence.net will automatically deduct the amount due by the Customer.
2.6 Steps to conclude the contract
When placing your first order via the Internet, all new customers must create a "Customer Account"; an identifier ("login") and a password of at least six alphanumeric characters will be requested. Each time you validate an order, you will be directed to your account via a secure connection, where you will be reminded of the contents of your order. Your order will not be definitively registered until all the information has been entered and the order has been validated. When you register your order by selecting a method of payment, the sale is deemed concluded (agreement on the goods and price).

The Customer acknowledges that he/she is fully aware of the fact that his/her agreement to the content of the General Terms and Conditions of Sale does not require a handwritten signature, insofar as the Customer orders the products and services presented therein online. The "double click" associated with the authentication, non-repudiation and message integrity protection procedure constitutes an electronic signature. This electronic signature has the same value as a handwritten signature between the Parties.

The acceptance of your order is confirmed by the sending of an email automatically generated by our website to the email address indicated when creating your customer account. The contractual information is presented in French and will be the subject of a confirmation containing this information at the latest at the time of delivery.
2.7 Order validation
Any order validated by the customer entails final acceptance of these general terms and conditions of sale with no possibility of recourse except in the case of stock shortages or the application of the right of withdrawal. Each order will be confirmed by email with a summary of the entire order. For each first order, the customer will be asked to provide supporting documents (copy of ID and proof of address) by email or fax in order to validate the order. RemovablePoolFence.net cannot be held responsible for any fraudulent use of the customer's means of payment by a third party. Failure to receive these supporting documents within a period of two weeks or the receipt of non-compliant documents may result in the cancellation of the order.

For reasons of fraud limitation, RemovablePoolFence.net reserves the right to accept the sale by asking you to provide proof of your identity and place of residence, and the means of payment used. In this case, the processing of your order will be carried out as from the reception of these documents, except validation of order carried out directly by the service orders and with the discretion of RemovablePoolFence.net. RemovablePoolFence.net reserves the right to cancel your order in the absence of receipt of these documents or receipt of documents deemed non-compliant. RemovablePoolFence.net reserves the right to validate the order despite the non-receipt of supporting documents previously requested by email.

In accordance with article L121-20-2 of the French Consumer Code, any order for items made to measure and at the request of the customer cannot be cancelled by RemovablePoolFence.net.
2.8 Order cancellation
Any request to cancel an order for accessories (post, installation kit, drill bit, plug, etc.) must be sent to RemovablePoolFence.net via the "my account" section of the site and then confirmed by registered letter with acknowledgement of receipt to the following address: RemovablePoolFence.net - Customer Service - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France).

Any request to cancel an order made by post or telephone will not be processed or taken into account by RemovablePoolFence.net. In accordance with article L121-20-2 of the French Consumer Code, as Beethoven fences are personalised products made to order, no cancellation can be made to RemovablePoolFence.net for fences or gates and no returns will be made in the event of an order error on the part of the customer.
It is specified to professionals that no unilateral cancellation of an order on their part will be accepted without the agreement of RemovablePoolFence.net and that orders sent directly by the buyer or which are transmitted by the seller's representative agents are only binding on the seller when they have been accepted in writing. Any cancellation by the customer of an order or contract, outside the clauses provided for this purpose, will give rise to damages.
2.9 Invoice
The invoice is issued for each shipment. It is available in digital format. The Customer will receive an e-mail on which a link is indicated allowing him to consult his invoice online. They have the option of downloading and/or printing it, and of requesting a paper edition of their invoice from Customer Services (a charge of €1 including VAT per invoice sent).

3. Personalised quote

3.1 Customer obligations
In order to obtain a quote with our DevisPerso calculator, the customer must provide RemovablePoolFence.net with various information concerning their pool, its environment and the type of equipment required, in particular: length; width; depth; location and dimensions of the ladder, staircase or filtration unit; shape of the pool, choice of materials, options and additional equipment, etc... (non-exhaustive list). In order to obtain a personalised quotation, the customer must provide RemovablePoolFence.net with a certain amount of technical information as indicated on the information sheets for each product concerned. The customer must complete these accurately, date and sign them and return them by post to RemovablePoolFence.net - Service Devis - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France) or by email.
3.2 Responsibilities
RemovablePoolFence.net cannot be held liable in the event that the customer has provided incorrect information about the dimensions or environment of their swimming pool. Consequently, RemovablePoolFence.net will not take back or reimburse any non-conforming product that has been made to measure at the customer's request according to the information provided at the time of the quotation. In the case of an anomaly (price, quantity, technical problem, etc. ...), the customer must inform RemovablePoolFence.net immediately. In the event of a discrepancy, RemovablePoolFence.net reserves the right to modify, cancel or refuse the order placed through DevisPerso.

Consequently, in the event that the customer selects equipment that is not suitable for their pool using the quotation form offered on RemovablePoolFence.net, the customer will not be able to claim any failure to advise on the part of RemovablePoolFence.net and demand damages or any other compensation. In the event that the customer has ordered and received equipment not suitable for his pool, he must upon receipt of the latter contact customer service or after-sales service RemovablePoolFence.net by phone or through his customer account to find an amicable solution to his problem.

4. Means of payment

4.1 Payment methods
To validate and pay for their order, customers have several means of payment:
- By national and international bank card.
- By bank card in three and four instalments (via our partners Floa Bank, Banque Casino and Cetelem).
- By PayPal if the amount of the order is less than or equal to 300€.
- By credit with Cetelem Presto in 5x, 10x FREE, 20x, 48x or Floa Bank 10x.
- By bank transfer made payable to NETBUY SAS. The order number allocated to the customer must appear on the title of the transfer.
- By administrative mandate (administrations and local authorities).

Payment by national and international bank card is available if your order is registered and invoiced in the name of a private individual or professional whose bank card issuer is located in continental France or Monaco.

In the case of payment by bank transfer or money order, any bank charges are payable by the Customer.

Payment in 3 instalments by cheque is only authorised if you have paid in full for a previous order registered in several instalments. This payment method is available if your order is registered and invoiced in the name of a private individual (bank cheque cleared in euros at a bank domiciled in continental France) for an amount between 100€ and 6000€. NETBUY SAS reserves the right to accept cheques from a bank domiciled outside continental France if they can be cleared in euros in a bank domiciled in continental France. The 3 signed cheques must bear the order reference and the customer's identity document number on the back. A photocopy of the latter, together with the three cheques, must also be attached to the order form signed by the customer. The numbers of the 2 or 3 cheques made payable to NETBUY SAS must be consecutive and correspond to the delivery address of the order. Orders for which payment has not been received within 7 clear days of the order form being issued will be cancelled.

The Customer is informed that the cheques for his order may be subject to a request for a guarantee agreement by Certegy SNC (Transax), TSA 71110, 92407 Courbevoie Cedex. In the event of no guarantee or refusal by Certegy, the order may be cancelled by Innovanet SAS, and the cheques will then be returned to the Customer, who will have the option of using another means of payment offered on RobotPiscine.fr to pay for the order. Cetergy consults the Fichier National des Chèques Irréguliers (FNCI) of the Banque de France and uses an automated decision support process that uses information relating to payments by cheque that have already given rise to a request for security, supplemented if necessary by additional information requested from the customers concerned by telephone. This processing has been authorised by the CNIL. Additional information may be provided to customers on request, in particular concerning the procedures for exercising rights of access and rectification with Certegy, in writing to Certegy SNC - TSA 52222 - 92508 Rueil Malmaison Cédex.

By choosing to pay by cheque, the Customer is informed that Innovanet SAS cannot guarantee the availability of the item ordered or its delivery time, as the order becomes definitive once the Certegy agreement has been issued. The Customer's order will only be definitively validated once the cheque has been cashed and validated by the bank. This cashing period generally varies from 7 to 15 days. Moreover, payment by cheque is not accepted for items covered by a special operation announced on the Site or during sales or private sales.

Payment by administrative order is reserved for public authorities. The signed and stamped order form accompanied by proof of payment by postal order must be returned to NETBUY SAS by email, fax or post. 4.2 Order processing
Any order paid by cheque, money order, finance, or bank transfer will only be processed once payment has been received and cleared by the RemovablePoolFence.net orders department. The delivery and shipping times indicated on the site will only apply from the date the order is processed. 4.3 Financing your order
Total financing of your order by conventional credit with a financial institution partner of RemovablePoolFence.net. The customer must provide the information necessary to establish a financing file by completing the form provided for this purpose and available when selecting the means of payment. On receipt of the customer's information, RemovablePoolFence.net will request prior approval of the financing from its partner. In the event of refusal by the financial partner, the customer will be notified by email and in the "my account" section. In this case, the customer may select another means of payment, failing which the order will be automatically cancelled. On credit with Cetelem Presto
RemovablePoolFence.net in partnership with Cetelem Presto offers you to pay for your order in 5x, 10x free, 20x, 30x or 48 times paying. This payment method is reserved for private individuals residing in Metropolitan France.

A loan commits you and must be repaid. Check your repayment capacity before committing yourself.

Example excluding optional insurance: for a purchase and a loan ancillary to a sale of €1,000 over 10 months at a fixed Annual Percentage Rate of 11.90% (fixed borrowing rate of 11.30%), you repay 10 monthly instalments of €105.25, interest: €52.50, total amount due: €1,052.50. The cost of optional insurance (Death, Total and Irreversible Loss of Autonomy, Illness-Accident), taken out with Cardif Assurance Vie and Cardif Assurances Risques-Divers, is €2/month and is added to the monthly payment in the example above.

5. Delivery

5.1 General
Products purchased on RemovablePoolFence.net can only be delivered to the delivery address indicated by the customer in continental France, Corsica and the Principality of Monaco (non-exhaustive list). RemovablePoolFence.net will not deliver any product to a P.O. Box or Army type address and reserves the right to refuse any shipment outside mainland France.

Shipments outside mainland France will only be made with the express agreement of RemovablePoolFence.net. The postage and packing charges shown on RemovablePoolFence.net are only valid for deliveries to mainland France (excluding islands). RemovablePoolFence.net will inform the customer by email of any additional shipping costs for all shipments outside continental France. If there is no response from the customer within 48 hours from the date the email is sent, and in order not to delay the processing of the order, RemovablePoolFence.net will debit the amount of the additional charges from the credit card used to pay for the order. In the event of delivery to the Customer's place of work, as the carrier does not have access to offices, laboratories or warehouses, the Customer must make all the necessary arrangements with the reception desk to ensure that the order is handed over. Upon presentation of the parcel by the postal services or by the carrier at the address indicated by the Customer, RemovablePoolFence.net has fulfilled its delivery obligation. RemovablePoolFence.net therefore declines all responsibility in the event of subsequent loss or theft. The products will be delivered with a non-valued Delivery Note (the invoice is available on RemovablePoolFence.net). No collection will be made by the purchaser from the premises of RemovablePoolFence.net or from shops operated by NETBUY SAS.
5.2 Deadlines
The lead times indicated on the site are lead times for dispatch of goods in mainland France (excluding islands). The icons displayed on the site indicate the time taken for the goods to be dispatched by our logistics department or by our suppliers. Dispatch times of 24 to 48 hours apply only to products held in stock in our warehouses and for which the icon indicating that the product is in stock is displayed on the product page. A storage fee of €15 per day will be charged to the customer in the event of non-delivery of the parcel beyond 6 days after it has been picked up by the carrier due to no response or inability to contact the customer to make an appointment.
5.4 Conditions
Any order paid by cheque, bank transfer, finance or money order will only be processed once it has been received and cashed by the RemovablePoolFence.net customer service department. Consequently, the delivery and shipping times indicated on the site will only apply from the date the order is processed. The customer must notify the carrier and RemovablePoolFence.net of any reservations regarding the item delivered (missing item compared to the delivery note or order form, damaged or already opened package, broken products, etc.) within 48 hours of receiving the package. After this period, any request will be rejected by RemovablePoolFence.net.
5.5 Transport
The risks associated with transport are borne by the seller, on condition that the buyer has checked the goods on receipt in the presence of the carrier and has indicated in writing on the transport note, if necessary, the reservations observed and this even in the case of carriage paid dispatch. Unless otherwise agreed, the seller is free to choose the carrier. If the package is too damaged, the buyer must refuse it. The transport insurance offered by RemovablePoolFence.net only covers the loss or theft of goods during transport. Parcels handed over to third parties are excluded: acceptance of the parcel or signature of the delivery note by a person other than the addressee. Some parcels sent by the Post Office or by carriers are given to the recipient against signature. Any claim made by the recipient of the package without the signature of the latter upon delivery of the package will be refused by RemovablePoolFence.net. Any claim made beyond this period will not be accepted and will release RemovablePoolFence.net from any liability.
5.6 Late delivery
In the event of a delay in delivery by the Post Office within eight working days of the dispatch date indicated in the "tracking - dispatch notice" email, we suggest that you check with your post office to ensure that the parcel is not pending, and then if appropriate, we invite you to report the delay by contacting our Customer Service by telephone or from your personal account. We will then contact the Post Office so that an investigation can be opened. This investigation may take up to 21 working days from the date it is opened. If during this period, the product is found, it will be re-routed as soon as possible to your home. 6.2 Complaints
For any complaints, we invite you to contact our services by logging on to our website and visiting your customer account. All claims relating to a defect in the goods delivered, an inaccuracy in the quantities or their incorrect reference in relation to the accepted offer or confirmation of the order by RemovablePoolFence.net, must be made to RemovablePoolFence.net by registered post within 48 hours of receipt of the goods, without neglecting if necessary and in accordance with Article 5.5 recourse against the carrier, failing which the buyer's right to claim will cease to be acquired.
6.3 Need for a returns number
Goods may only be returned by post, unless otherwise stated. 6.4 Need for original packaging
Any defective product must be returned in its original packaging, which alone enables the product to be transported under good conditions, with the guarantee labels, include all of the product and its accessories and be accompanied legibly by the returns number. Cash on delivery will not be accepted. 6.8 Late delivery

If your order does not have a dispatch number, please contact us via your customer account to find out how long it will take for your parcel to arrive. Any intervention by RemovablePoolFence.net beyond the first year of warranty is at its discretion (except in the case of a manufacturer's warranty of more than 1 year). If RemovablePoolFence.net assumes responsibility for the warranty beyond the first year, transport and intervention costs may be invoiced to the end Customer, who will be informed in advance of the precise amount of this intervention by means of an estimate which will be available in his customer account. Depending on the product and the date of purchase, the repair will be carried out either by RemovablePoolFence.net or by the manufacturer directly.

This warranty does not cover damage resulting from the use of the product. This guarantee does not cover damage resulting from accidents, misuse, negligence or significant modification of the appearance or operation of the equipment returned. In the event of a possible return to the manufacturer for a quotation to repair the equipment outside the guarantee, administrative and carriage costs will be invoiced for the return of the equipment if the quotation requested is refused. The amount of the administrative and carriage costs for returning the product will be indicated in an estimate that will be sent to the Customer. If the breakdown is the result of user damage, or is excluded from the warranty (worn parts, incorrect use, etc.), a repair estimate will be sent to the Customer via their customer account. If the Customer refuses to accept the estimate and does not pay the amount due within 3 months, RemovablePoolFence.net reserves the right to resell the equipment in order to cover the costs incurred for the expertise of the equipment. In the event of non-recovery by the customer, the equipment may also be scrapped.

After payment of the amount due and in the event that the Customer wishes to use a carrier to collect the product, the Customer must inform RemovablePoolFence.net of this wish and provide the name of the carrier as well as the date of the planned collection. RemovablePoolFence.net cannot be held responsible in the event of damage during the delivery of the material by the carrier appointed by the Customer.
6.10 Return of equipment to after-sales
After agreement from our services, you must return your product to us within 5 working days accompanied by the returns slip and a photocopy of the invoice. Any equipment that has been immersed in water or has come into contact with water must be perfectly dry before being sent back. In accordance with article 6.4, any defective product must be returned in its original packaging. In the event that the packaging of the product is not sufficient (lack of protection), the customer must overwrap the package in a second cardboard box specially designed for shipping and secure it with adequate protection. In the event that certain spare parts or items need to be replaced, you will be asked to return the defective part to the address given on your returns form in order to receive the replacement products. Any product returned due to a breakdown which is found to be in good working order or damaged by the Customer (see conditions of exclusion in article 12 of these general conditions), will be returned to you at your expense, plus a fixed charge of 30 euros to cover the logistical and technical costs incurred by RemovablePoolFence.net. If the equipment has been inspected by the manufacturer's after-sales service (motor, electrical box, etc.), the inspection costs will be invoiced to you at the manufacturer's current rate. The non-defective equipment will be returned to the Customer after full payment of the sums due in the context of the expert assessment carried out by RemovablePoolFence.net or by the manufacturer, including the cost of returning the equipment to your home. A quotation including the flat rate of 30€ (or the manufacturer's appraisal costs) as well as the transport costs for the return of the goods will be available in your Customer account for validation. In the event of refusal to accept the quotation and non-payment of the amount due within 3 months, RemovablePoolFence.net reserves the right to resell the equipment in order to cover the costs incurred for the expertise of the non-defective equipment. In the event of non-recovery by the customer, the equipment may also be scrapped.

After payment of the fixed price and in the event that the Customer wishes to use a carrier to collect the product, the Customer must inform RemovablePoolFence.net of this wish and provide the name of the carrier as well as the planned day of collection. RemovablePoolFence.net cannot be held responsible in the event of damage during the delivery of the goods by the carrier appointed by the Customer.

Any goods returned by the carrier following the delivery of the goods will not be refunded. Any equipment returned by the carrier following a refusal of delivery on the part of the Customer or not claimed by the Customer will be kept for 3 months in our warehouses, after which time the equipment will be scrapped.

We therefore invite you, prior to any return, to contact us. 7. Availability

Certain items such as professional heaters for public or collective swimming pools are made to order by the manufacturers and require variable manufacturing and delivery times depending on their technical nature. RemovablePoolFence.net will send an email to the customer giving an approximate date of availability of the item when the order is placed. RemovablePoolFence.net cannot be held responsible for any delay in the manufacture or delivery of items to the customer.

If the item ordered is unavailable after the customer has placed the order, RemovablePoolFence.net will inform the customer by email as soon as possible. In this case, RemovablePoolFence.net will offer the customer a replacement item of equivalent value and quality. If the customer refuses this replacement item or if RemovablePoolFence.net is unable to provide one, the order will be automatically cancelled and refunded. Unavailable items are only removed from the RemovablePoolFence.net catalogue if they are permanently out of stock with our suppliers. Otherwise, the customer may renew the order as soon as the item is again available from our suppliers and has been restocked.

Failure to comply with these obligations (non-compliant installation) may result in the warranty being invalidated, and repairs will be invoiced to the customer. An estimate will be drawn up prior to each out-of-warranty intervention; if the estimate is refused by the customer, the equipment will be re-sent to the customer at the customer's expense without any intervention on the equipment by the after-sales service.
8.2 Installation by a professional
Certain materials and equipment sold on RemovablePoolFence.net must be installed by a professional or an approved installer in order to benefit from the manufacturer's warranty. The customer should therefore ensure before any installation that the equipment can be installed/commissioned by a non-professional. This type of information is generally specified in the assembly instructions, the instructions for use or the warranty card delivered with the product. In the event that this information does not appear on the documents supplied with the equipment, the customer must contact the RemovablePoolFence.net after-sales service before installing the equipment in question.

The customer certifies that he/she is in possession of all the information required for the installation of the equipment. The customer certifies that he has the means to proceed with the installation of the products delivered, RemovablePoolFence.net only making the delivery. It is the sole responsibility of the Buyer, if it does not consider itself sufficiently competent to install the equipment, to seek the assistance of an advisor or a professional.
8.3 Installation in accordance with the Standard
Beethoven barriers must be installed in accordance with the current standard. It is therefore the customer's responsibility to ensure that their installation complies with the standard, in particular by respecting the precise criteria of the standard concerning the support points which must be located 1.10m from the barrier. Estimates produced by RemovablePoolFence.net are based solely on information provided by customers by email. RemovablePoolFence.net has no knowledge of the precise environment of the customer's swimming pool and therefore cannot confirm to the customer that the installation and layout of the barrier will comply with the standard in force. RemovablePoolFence.net cannot be held responsible if the customer does not comply with the manufacturer's installation instructions, does not comply with the recommendations and obligations of standard NF P90-306 and for any non-compliant installation carried out by the customer. RemovablePoolFence.net declines all responsibility in the event of drowning of persons or animals despite the installation of a Beethoven swimming pool barrier.

9. Transfer of ownership

9.1 General
The transfer of ownership of items purchased on RemovablePoolFence.net to the customer will only be made after full payment of all sums due and this regardless of the date of delivery of the items to the customer. In accordance with Law 80-335 of 12/05/80 and Law 85-89 of 25 January 1985, the goods delivered shall remain our property until full payment of the price, even if they are no longer in the possession of the purchaser. The transfer of ownership and the execution of these general conditions of sale apply only to the customer who placed the order. 10. Applicable law

10.2 Application of French law
This contract is governed by French law. The application of the Vienna Convention on the International Attribution of Goods is expressly excluded. RemovablePoolFence.net will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code. The computerized records of RemovablePoolFence.net will be considered by the parties as proof of communications, orders, payments and transactions between the parties, unless proven otherwise. The electronic signature constituted by the "double-click" procedure when the order is placed and recorded has handwritten value between the parties. French law is applicable without prejudice to the application of mandatory legislative rights granted to consumers or of a more protective mandatory law by a foreign court seized by a consumer in the corresponding country.

All disputes relating to the formation, performance and termination of contractual obligations between the parties which cannot be settled amicably will be referred to the French courts. In the case of a dispute with professionals and/or merchants, it will be subject to the jurisdiction of the Tribunal de Commerce de Grasse in whose jurisdiction the head office of RemovablePoolFence.net is located, regardless of the conditions of sale and the method of payment accepted, even in the event of a third party claim or multiple defendants, RemovablePoolFence.net reserving the right to bring the matter before the Court with territorial jurisdiction over the head office of the purchaser. 10.3 Scope of these conditions

12. Warranty & Liability

12.1 General
The items offered by RemovablePoolFence.net, unless otherwise stated on the product sheet (clearance, demonstration equipment, bargains), are sold new and in their original packaging. They are identical in all respects to those offered by traditional distribution networks. Any warranty longer than 1 year offered by the manufacturer must be paid for directly by the manufacturer to the end customer. Items for which the warranty period is not specified on the product sheet, spare parts and products sold in the "Destockage" section benefit from a 1-month warranty. Consumables (cleaning accessories, brushes, chemical products, etc.) and wearing parts are not covered by any guarantee.

In accordance with the law, the customer has the right to cancel the guarantee. In accordance with the law, the customer benefits from the provisions of the legal guarantee relating to hidden defects once the order has been paid in full. The conditions and duration of the manufacturer's guarantee are indicated on the information sheet for the items presented on RemovablePoolFence.net. No guarantee will be accepted without the presentation of the purchase invoice for the item. RemovablePoolFence.net will not accept any item for which the guarantee has expired.

The following are excluded from the warranty: Exclusions from the manufacturer's commercial warranty; Damage resulting from failure to comply with the manufacturer's instructions; Routine maintenance operations as well as accessories and consumables; Damage of an aesthetic nature; Theft, fire, and all risks covered by comprehensive home insurance; Equipment that has undergone a modification of its specifications; Equipment that has been dismantled by a company not approved by RemovablePoolFence.net; Non-compliance with maintenance prescriptions and instructions; Abnormal or non-compliant use of the item; Defects and their consequences related to use that does not comply with the use for which the product is intended (professional, collective use ...); Products subject to a specific assistance and maintenance contract.
12.2 Responsibilities
The company NETBUY SAS is not the producer of all the products presented, within the meaning of law n°98-389 of 19 May 1998 relating to liability for defective products.

RemovablePoolFence.net is not the manufacturer of the items sold on the site, and cannot be held liable in the event of damage caused to property or a person as a result of a defect in the item. The customer must engage the responsibility of the manufacturer of the item purchased. RemovablePoolFence.net shall not be liable for any loss of business or profits arising out of the use of the site and the conclusion of the contract of sale between the customer and RemovablePoolFence.net.

The customer shall be fully liable for any breach of the general terms and conditions of sale and/or use of the site and any special terms and conditions/restrictions set out on the pages of the site. RemovablePoolFence.net cannot be held responsible for any damage caused by the non-respect of the texts and articles mentioned on the site as well as the violation by the customer of the laws in force, import rights including the regulations of the national and international carriers, in particular during the delivery of chemical, prohibited or dangerous products.

The responsibility of RemovablePoolFence.net cannot be held liable for any commercial or financial loss suffered by the customer as a result of a manufacturing defect or technical problem with the product received, damage to or loss of the package by the carrier, in particular losses related to the impounding of pools and spas and their maintenance (filling, draining, water treatment products, electricity, etc.). RemovablePoolFence.net cannot also be held responsible for losses resulting from breakdowns in the electrical filtration equipment (pool pump, filtration unit, etc...) leading to the pool's filtration being stopped during the after-sales service procedure and assessment of the product by the manufacturer.

In the event that this information does not appear on the documents supplied with the equipment, the customer must contact the RemovablePoolFence.net after-sales service before any installation of the equipment concerned.
12.3 Hardware warranty
If an item is faulty or does not conform during the warranty period, the customer will contact RemovablePoolFence.net's customer service department who will advise them of the procedure to follow for returning the equipment. No returns will be accepted without the prior authorisation of RemovablePoolFence.net and the equipment will be returned to the sender at the customer's expense. No item may be the subject of on-site intervention. All guarantees are for return to the workshop. Any assembly/disassembly costs for defective parts are at the Customer's expense.

In the event that the equipment installed/launched requires the presence of a professional or a technician from NETBUY SAS during an after-sales service intervention by the manufacturer, travel and/or accommodation costs will be invoiced to the Customer and payable in full prior to any intervention by one of our technicians or an approved professional. Travel or interventions will only be carried out in Metropolitan France (excluding Corsica). RemovablePoolFence.net cannot be held responsible for the on-site replacement of defective parts under the manufacturer's contractual warranty. The Customer waives all recourse against RemovablePoolFence.net concerning travel and/or labour costs, including in the event of installation by one of its partners of the equipment purchased by the Customer.

The product under warranty will, at the Customer's option, be returned to RemovablePoolFence.net. Products under guarantee will be exchanged or repaired at the manufacturer's discretion. Items must be returned in their original, undamaged packaging and in perfect condition for resale with all the elements delivered (accessories, packaging, instructions, cabling, etc.). Any item that is damaged, incomplete or whose original packaging has deteriorated will not be taken back, reimbursed or exchanged and will be sent back to the customer carriage forward. The costs and risks involved in returning the defective or non-compliant item remain the responsibility of the customer.
12.4 Exclusive 5-year warranty
When you buy a Beethoven swimming pool barrier on our site, RemovablePoolFence.net gives you an exclusive 5-year guarantee under the conditions below:
- The 5-year guarantee applies exclusively to Beethoven swimming pool barrier modules, excluding the net, gate and accessories. - The 5-year guarantee is non-transferable and valid only for the first holder of the guarantee (1st purchaser). - This guarantee comes into effect on delivery and covers all manufacturing defects encountered during the guarantee period. - During the first and second years, the guarantee is total and covers any repair or replacement costs. Any reduction in value due to use is then taken into account. In the third year, a contribution of 30% is required, in the fourth year 50% and in the fifth year 70%, excluding transport and administration costs. - All Beethoven barrier modules come with a 2-year guarantee on the netting, braiding and accessories, fittings or PVC parts (plugs, sleeves, caps, etc.) supplied with the modules.
- You cannot make use of the guarantee if defects have appeared as a result of: misuse, failure to follow the manufacturer's instructions, use of non-compatible products, traces of impact, incomplete product, non-compliant installation, etc....

13. "Gold Guarantee" contract

13.1 General
The GOLD Contract applies to products exclusively distributed by RemovablePoolFence.net with the exception of products sold by partner sites. The warranty is therefore only offered on the www.RemovablePoolFence.net website. The Gold Contract only covers faults that fall within the scope of the manufacturer's warranty. The product must have been used under normal conditions and in accordance with the instructions supplied with the product. Products that have been damaged as a result of misuse or failure to follow the manufacturer's instructions will not be covered by the GOLD Contract.

Private swimming pool heaters used for professional purposes (collective or public swimming pools) will not be covered by the Contrat OR warranty.

Also excluded from the Contrat OR warranty are consumable products (chemicals, spare parts, covers, etc.) and all products that do not bear the Contrat OR logo on their label.

The duration of the Contrat OR warranty is one year. The duration of the GOLD Contract is one or two years (or 90 days depending on the product) and begins on the date of the invoice, as evidenced by the invoice date. The duration of the GOLD Contract is indicated on the product sheet and in your basket. The new product selected as part of the Gold Contract will benefit from the original manufacturer's warranty indicated on the product sheet.

Throughout this period, this guarantee entitles you to a voucher equivalent to the purchase value of the product excluding additional costs and services (the invoice is proof of this) and to order a new product from RemovablePoolFence.net to replace the repair of your faulty product. Voucher valid for 2 months on the entire site, excluding transport and promotions. The amount of the Gold Contract guarantee will be indicated in your basket before the order is validated.

To benefit from the Contrat OR guarantee, the option must be taken out at the same time as the purchase of the product and on the same order. The guarantee applies to the products selected in the basket and for which it is offered as an option. If you do not wish to benefit from the Contrat OR guarantee on a product, simply remove it from the basket before validating your order.

The Contrat OR guarantee is attached to the subscriber when the order is placed, and cannot be transferred, including in the event of resale of the product and/or change of ownership.

13.2 Use of the Gold Guarantee
Your product covered by the GOLD Contract warranty has broken down during the GOLD Contract subscription period and you would like to obtain your voucher in order to purchase a replacement product, nothing could be simpler.

To do this, simply log on to your RemovablePoolFence.net customer area, which you can access 24 hours a day, 7 days a week, using your email address and password. Go to your after-sales service section, select the defective product and request application of the Gold Contract guarantee.

For any questions relating to the application of the Contrat OR warranty, simply contact RemovablePoolFence.net Customer Service by telephone on 0811 909 411 (Azur number, price of a local call) from Monday to Friday from 9am to 12pm and from 2pm to 6pm.

On receipt of your request and after it has been processed by our services, a returns slip will be sent to you by email, giving you the postal address to which the faulty product should be returned for expert examination.

The faulty product must be returned in its original packaging, together with all the original accessories (instructions, cable, hoses, accessories, etc.), with the returns note visible on the parcel. Please note that products that have been immersed in or come into contact with water (heaters, pumps, etc.) must be dried before being dispatched. To guarantee you compensation in the event of loss or theft of the parcel during transit, we invite you to take out insurance with the Post Office or the carrier.

Upon receipt of the product and after an expert appraisal of the goods, we will send you an invoice. On receipt of the product and after our services have assessed the fault, which will take place within a maximum of 15 days, RemovablePoolFence.net will send you a voucher by email within 10 days for the same amount as you paid for the product when you placed your order. Your voucher will be valid for two months, after which it will expire and become inactive. You can only use the Gold Contract guarantee once per product.

You will be able to use your RemovablePoolFence.net voucher immediately to purchase a new product of your choice from our catalogue of over 250 references. If the price of the replacement product is higher than that of the faulty product, you can make up the difference using the payment method of your choice available on the site when the order is validated.

In the event that the ORDER Contract guarantee is not honoured, you will have to pay the difference by credit card. In the event that the Contrat OR guarantee cannot be applied following the technical inspection (faulty use, failure to follow the manufacturer's instructions, use of non-compatible products, operation without water, traces of impact, incomplete product, etc.), your request for a purchase voucher will not be considered. Your faulty product will then follow the standard after-sales service procedure, with the product being returned to the manufacturer for an in-depth assessment and a quotation for repairs.

On receipt of the manufacturer's estimate, a repair estimate will be sent to your customer area for validation. You will be able to choose the payment method of your choice to pay for this estimate. In the event of your refusal of the estimate produced, you will be invoiced for the costs of assessing the equipment and drawing up the estimate by the manufacturer and the product will be returned to you as is at your expense.

14. "Garantie ZEN" contract

14.1 General
The ZEN guarantee applies to products exclusively distributed by RemovablePoolFence.net with the exception of products sold by partner sites. The guarantee is therefore only offered on the www.RemovablePoolFence.net website. The ZEN warranty only covers faults that fall within the scope of the manufacturer's warranty. The product must have been used under normal conditions and in accordance with the instructions supplied with the product. Products which have been damaged as a result of misuse or failure to follow the manufacturer's instructions will not be covered by the ZEN guarantee.

Beethoven barriers for private swimming pools used for professional purposes (collective or public swimming pools) will not be covered by the ZEN guarantee.

The ZEN guarantee also excludes products which do not have the ZEN guarantee logo on their data sheet.

The duration of the ZEN guarantee is one year and begins on the day of invoicing, the date of the invoice being taken as proof. The duration of the ZEN guarantee is indicated on the product sheet and in your basket. The new product selected under the ZEN guarantee will benefit from the original manufacturer's guarantee indicated on the product sheet.

During this entire period, this guarantee allows you to obtain a voucher equivalent to the purchase value of the product excluding additional costs and services (the invoice being proof of this) and to order a new product from RemovablePoolFence.net to replace the repair of your defective product. To benefit from the ZEN guarantee, the option must be taken out at the same time as the purchase of the product and on the same order. The guarantee applies to the products selected in the basket and for which it is offered as an option. If you do not wish to benefit from the ZEN guarantee on a product, simply remove it from the basket before validating your order.

The ZEN guarantee is attached to the subscriber when the order is placed, and cannot be transferred, including in the event of resale of the product and/or change of ownership.

In the event of an incident in the payment of the order (payment in 3/4 times by CB or cheque, bank card, etc...), the ZEN guarantee will be suspended until full payment of the sums due. In the event that the defective product is in the possession of RemovablePoolFence.net, the Purchase Voucher will only be sent to the customer once the order has been paid in full.
14.2 Using the ZEN Guarantee
Your product covered by the ZEN warranty has broken down during the ZEN warranty subscription period and you would like to obtain your voucher in order to purchase a replacement product, nothing could be simpler.
To do this, simply log into your RemovablePoolFence.net customer area accessible 7/7 days and 24/24h using your email and password. Go to your after-sales service section, select the defective product and request the application of the ZEN guarantee.

For any question relating to the application of the ZEN guarantee, simply contact RemovablePoolFence.net Customer Service by telephone on 0977 55 09 44 (+33 977 55 09 44 from abroad) from Monday to Friday from 9am to 12pm and from 2pm to 6pm.

On receipt of your request and after it has been processed by our services, a returns slip will be sent to you by email giving you the postal address to which the faulty product should be returned for expert examination.

The defective product must be returned in its original packaging along with all the original accessories (instructions, cable, hoses, accessories, etc.) with the returns note visible on the parcel.

To guarantee you compensation in the event of loss or theft of the parcel during transit, we invite you to take out insurance with the Post Office or the carrier.

On receipt of the product and after an assessment of the fault by our services, which will take place within a maximum of 15 days, RemovablePoolFence.net will send you a voucher by email within 10 days for the same amount as that paid for the product when the order was placed. Your voucher will be valid for two months, after which it will expire and become inactive. You can only use the ZEN guarantee once per product.

You will then be able to use your voucher immediately on RemovablePoolFence.net to purchase a new product of your choice from our catalogue. In the event that the price of the replacement product is higher than that of the defective product, you will be able to make up the difference using the payment method of your choice available on the site when the order is validated.

In the event that the ZEN guarantee cannot be applied following technical expertise (faulty use, failure to follow the manufacturer's instructions, use of non-compatible products, traces of impact, incomplete product, etc.), your request for a purchase voucher will not be taken into account. Your faulty product will then follow the standard after-sales service procedure, with the product being returned to the manufacturer for an in-depth assessment and a quote for repairs.

On receipt of the manufacturer's estimate, a repair estimate will be sent to you in your customer area for validation. You will be able to choose the payment method of your choice to pay for this estimate. In the event of your refusal of the estimate produced, you will be invoiced for the costs of assessing the equipment and drawing up the estimate by the manufacturer and the product will be returned to you in the same condition at your expense.

15. Loyalty programme

15.1 Joining the programme
The RemovablePoolFence.net loyalty programme is developed and managed by the company NETBUY SAS with capital of €70,000, 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France), RCS CANNES 822 581 633. These general terms and conditions define the terms and conditions for participation in the loyalty programme, which enables you to accumulate points and benefits based on purchases made on RemovablePoolFence.net.

The Programme Customer is any natural person of legal age who wishes to join the RemovablePoolFence.net loyalty programme and who meets the general conditions of enrolment as defined herein.

Membership of the RemovablePoolFence.net loyalty programme can only be registered and validated if the information provided by the Customer on the membership form is complete, legible and usable. The company NETBUY SAS reserves the right to modify the conditions for issuing loyalty points at any time.
15.2 Obtaining points and benefits
The RemovablePoolFence.net loyalty programme allows points to be accumulated for each purchase on the RemovablePoolFence.net site, on presentation or by identification of the Customer, on the basis of 10 euros net (excluding delivery charges) = 1 point, purchase points are generated within 15 days after dispatch of the last package of the Customer's order. The use of gift cards, vouchers, credit notes or promotional codes when validating the order does not give rise to points (zero points balance for this order). If items are refunded (including gift cards), the points earned for these products will be deducted from the customer's loyalty account and the day's purchase will be lost if the balance of the day's purchase amount is less than or strictly equal to zero.

In the event of a claim on the points balance, the customer must submit proof of purchase by post to the company NETBUY SAS at the following address: NETBUY SAS - Service Clients - 230 ROUTE DES DOLINES - CS 90060 - 06906 VALBONNE CEDEX (France).

Loyalty points credited to your customer account are valid for 180 days after the order date. Loyalty points not used within this period will be permanently lost. The date and number of loyalty points cancelled will be shown separately in your personal account.
15.3 Using points
Points are debited when a loyalty voucher is triggered by the customer when their order is validated. The number of points available and the amount of the corresponding voucher is indicated in the Customer's basket and on the order validation page. The customer must first activate their RemovablePoolFence.net customer account in order to use the loyalty voucher. These loyalty vouchers cannot be exchanged or split and are neither compensable nor refundable in cash.

It is not possible to use these vouchers for any other purpose. It is only possible to use one loyalty voucher for the same purchase on the RemovablePoolFence.net website.

Loyalty vouchers are valid for 7 days for a minimum amount (excluding delivery costs) of the value of the voucher. For each order using a loyalty voucher on www.robotpiscine.fr, the order balance (excluding delivery costs) must be at least €15. When making a purchase with a loyalty voucher, the amount of the voucher will not be taken into account when calculating points.
15.4 Modification/suspension/termination of the loyalty programme
The company NETBUY SAS reserves the right to modify these general terms and conditions at any time and will inform the Customer of any modification by inviting him to regularly consult the general terms and conditions of the Loyalty Programme on the RemovablePoolFence.net

website. The company NETBUY SAS reserves the right to suspend or terminate the Programme at any time. The suspension or termination of the Programme will be announced by the most appropriate means (letter, email, SMS, posting on the website, etc.). If the Programme is terminated or suspended, any Vouchers that have not expired may be redeemed within 7 days of their allocation date. No Customer may take legal action against the company NETBUY SAS for any reason whatsoever. No modification or deletion will entitle the Customer to compensation.
15.5 Reservation of title
The company NETBUY SAS is exonerated from all liability for the direct or indirect consequences of any anomalies and malfunctions of the RemovablePoolFence.net loyalty card, whatever their causes. The company NETBUY SAS will nevertheless do its utmost to ensure that, in the event of a malfunction, each Customer retains the benefit of his or her accumulated points and advantages.

In the event of a dispute regarding the amount accumulated, only the information contained in the company's database, NETBUY SAS, will be deemed authentic. Any intentional breach of these General Terms and Conditions, any abusive or fraudulent use of the advantages offered by the Programme, any behaviour prejudicial to the interests of the company NETBUY SAS, any falsification of the information transmitted by a Customer or by a third party acting on behalf of a Customer, will automatically result in the removal of the Customer from the register, the cancellation of his/her points or of any advantages he/she may have obtained, without compensation of any kind and without prior notification.

The deprivation of the Customer's status means the liquidation of their Personal Account, the deactivation of the RemovablePoolFence.net Card, the impossibility of using the Loyalty Points and Purchase Vouchers held.

16. Extended warranty

16.1 Reminder of legal provisions
Independently of the contractual guarantee developed below, RemovablePoolFence.net remains liable for defects in conformity of the goods with the contract under the conditions provided for in Articles L.211-1 of the following of the Consumer Code and for redhibitory defects under the conditions provided for in Articles 1641 to 1649 of the Civil Code.

Art. L.211-4 of the Consumer Code:
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity that exists at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his responsibility.

Article L.211-5 of the Consumer Code:
To comply with the contract, the goods must:
1° Be fit for the purpose normally expected of similar goods and, where applicable:
- correspond to the description given by the seller - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
- have the qualities that a buyer may reasonably expect of a similar product;
- be free from defects in materials or workmanship. - have the qualities that a purchaser may legitimately expect having regard to public statements made by the seller, the producer or his representative, particularly in advertising or labelling;
or 2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.


Art. L.211-12 of the Consumer Code:
Any action resulting from a lack of conformity must be brought within two years of delivery of the goods.


Art. Art. 1641 of the French Civil Code:
The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them.

Art. Art. 1648 paragraph 1 of the Civil Code:
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
16.2 Conditions of the contractual warranty
This contract guarantees the repair of the appliance following damage affecting its correct operation and arising from a phenomenon of internal origin. The guarantee is valid throughout mainland France and the Principality of Monaco. In order to benefit from the product guarantee, it is essential to keep the purchase invoice. This is the only proof of purchase. The guarantee begins on the date of receipt of the product. The delivery note must therefore be kept by the Customer as proof. Failing this, the guarantee will commence on the product invoice date. It will end at the end of the period defined by the manufacturer for the said product.
Under these conditions, the Company NETBUY SAS to ensure the correct operation of appliances that have suffered a breakdown of internal origin; this guarantee covers the replacement of defective parts and labour. All equipment must be returned to the after-sales service designated by RemovablePoolFence.net

Exclusions from the guarantee, NOT COVERED BY THE GUARANTEE:
- Damage involving the responsibility of a third party or resulting from an intentional or malicious fault .
- Damage resulting from the use of energy, use or operation that does not comply with the manufacturer's instructions or negligence.
Replacement of consumables, parts or accessories. - Replacement of consumable parts, such as seals, filters, batteries, brushes, accessories and display parts, lamps, screws, etc..
- Connection or commissioning errors .
- Damage resulting from industrial or commercial use .
- Damage resulting from fire, lightning, storm or vandalism .
- Material and immaterial damage resulting from the breakdown of the appliance (loss of use, contents of appliances, etc.). Replacement : If the appliance is beyond repair, the Company NETBUY SAS undertakes to compensate you on the basis of the initial value less a depreciation determined at the rate of 1.50% per month from the 181st day following the date of delivery (in accordance with article L 211-7 of the French Consumer Code), to be applied to a replacement appliance with the same function, purchased from the Company NETBUY SAS. This provision may also be offered in the event of repairs costing more than the market value defined in the above terms.
In this same case, the Company NETBUY SAS may replace the irreparable appliance with a new appliance of the same characteristics by applying the obsolescence coefficient set out above to the price. The customer will then be required to pay the difference between the price of the new appliance and the value of the old appliance after application of the obsolescence calculation. If the price of the replacement appliance is lower than the price of the appliance being replaced, after deduction of obsolescence, the difference will be covered by a voucher valid for one year, which will be given to the customer. In the event of the replacement of equipment under the contractual warranty, the new equipment will not benefit from a new contractual warranty but will be covered by the warranty period remaining until the expiry of the initial contractual warranty. The period of availability of functional spare parts is equal to the period of the contractual warranties.
16.3 Conditions for chargeable services - Extended warranty
The Company NETBUY SAS undertakes to offer you at the time of sale the subscription of a warranty extension for certain product families allowing the warranty to be extended up to 5 years depending on the product family. This extended warranty covers the replacement of parts (see special conditions) and labour under the same conditions as the contractual warranty.
16.4 Validity of the extended warranty
The application of the guarantee extension is subject to the presentation at each intervention of the invoice justifying the subscription and payment of the guarantee extension. All repairs must be carried out by the Company's after-sales service NETBUY SAS failing which the guarantee shall be null and void. The warranty extension is non-transferable and non-renewable.
16.5 Warranty extension exclusion
Identical to contractual warranty exclusions, article 16.2
16.6 Replacement
Identical to the terms of the contractual guarantee, Article 16.2. In addition, in the event of the replacement of equipment in execution of the warranty extension, the new equipment does not benefit from a new warranty extension but from the warranty period remaining until the expiry of the initial warranty extension.
